1. Agreement to Terms

By accessing or using KeywordKit ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

KeywordKit is a web-based App Store keyword intelligence platform that provides keyword scoring, competitor analysis, demand signals, listing generation, and related tools for app developers. The Service is provided on a subscription basis with free and paid tiers.

3. Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

4. Subscription Plans and Payment

4.1 Free Plan

The free tier provides limited access to the Service as described on our pricing page. Features and usage limits may change at any time.

4.2 Paid Plans

Paid subscriptions (monthly, annual, or lifetime) are billed through our payment processor, Lemon Squeezy. By subscribing to a paid plan, you authorize recurring charges at the applicable rate until you cancel.

4.3 Pricing Changes

We reserve the right to change pricing at any time. Existing subscribers will be given at least 30 days' notice before any price increase takes effect on their account. Lifetime plan holders are not subject to future price changes.

4.4 Taxes

Prices may be exclusive of applicable taxes. Lemon Squeezy handles tax collection where required by law.

6. Acceptable Use

You agree not to:

  • Use the Service to violate any applicable law or regulation
  • Attempt to reverse-engineer, scrape, or extract the underlying data or algorithms of the Service
  • Use automated tools (bots, scripts, crawlers) to access the Service beyond normal API usage
  • Share your account credentials with others or resell access to the Service
  • Use the Service in any manner that could damage, disable, or impair its operation
  • Circumvent any usage limits, access controls, or security features

7. Intellectual Property

7.1 Our Property

The Service, including its design, code, algorithms, scoring models, and branding, is owned by KeywordKit. Nothing in these Terms grants you ownership of any intellectual property.

7.2 Your Data

You retain ownership of any content you create using the Service (such as generated listings or saved keywords). We do not claim ownership of your data.

7.3 Data Sources

Keyword data, app metadata, and related information displayed in the Service is sourced from publicly available APIs (including Apple's iTunes Search API, Google Trends, and Reddit). We do not guarantee the accuracy, completeness, or timeliness of third-party data.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure
  • Keyword scores, revenue estimates, or demand signals will be accurate or lead to specific outcomes
  • Any particular keyword strategy will result in App Store rankings or downloads

The Service provides data and analysis to assist your decision-making. Results depend on many factors outside our control.

9. Limitation of Liability

To the maximum extent permitted by law, KeywordKit and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use of or inability to use the Service
  • Any decisions made based on data or analysis provided by the Service
  • Unauthorized access to or alteration of your account
  • Any third-party conduct on the Service

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Cancellation and Termination

10.1 By You

You may cancel your subscription at any time through your account settings or via Lemon Squeezy. Upon cancellation, you will retain access to paid features until the end of your current billing period.

10.2 By Us

We reserve the right to suspend or terminate your account if you violate these Terms. In the event of termination for cause, no refund will be provided.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or the Service shall be subject to the jurisdiction of the courts of South Africa.

13. Consumer Protection

If you are a consumer in South Africa, nothing in these Terms limits your rights under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002.
